By downloading, installing, or using Nightbook ("the App") or visiting nightbook.app ("the Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.
Acceptance of terms
By accessing Nightbook, you confirm that you are at least 13 years of age, that you are legally able to enter into these Terms, and that you will use the App and Website in accordance with applicable laws and the Apple App Store terms of service.
Description of the service
Nightbook is a freemium iOS journaling app that turns journal entries into stars in an interactive night sky. The App is available with a free tier (limited to three entries per week) and paid subscription or lifetime purchase options that unlock unlimited entries and additional features. Features, pricing, and availability may change over time.
Subscriptions and billing
Nightbook offers paid access through monthly, annual, and lifetime purchase options. All billing, renewals, cancellations, and refunds are processed by Apple under the App Store terms that apply to your account. To manage or cancel a subscription, go to Settings on your iPhone, then tap your name, then Subscriptions. Nightbook does not process payments directly.
User content ownership
You retain full ownership of the journal entries, titles, constellation names, mood tags, and any other content you create in Nightbook. By using the App, you grant Nightbook only the limited, non-exclusive rights necessary to store, display, and export that content on your device and, where you have enabled iCloud, to sync it through Apple's services on your behalf.
Acceptable use
You agree not to misuse the Service. This includes, but is not limited to: interfering with the App's operation; attempting to reverse-engineer, decompile, or disassemble the App except where permitted by law; using the Service in a way that harms other users, Apple, or the Service itself; or using the Service for any unlawful purpose.
Intellectual property
The Nightbook name, logo, visual design, animations, sound design, and all other intellectual property associated with the App and Website are owned by Nightbook and protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without prior written permission.
Limitations and availability
Some features may depend on device capabilities, iOS version, iCloud settings, notification permissions, or Apple services. Nightbook may occasionally be unavailable due to maintenance, updates, or circumstances beyond our reasonable control. We do not guarantee uninterrupted access to the Service.
Termination
You may stop using Nightbook at any time by deleting the App. Access to paid features will end if your subscription lapses or if Apple terminates the relevant transaction. We reserve the right to suspend or terminate access to the Service where reasonably necessary to protect the Service, other users, or to comply with applicable law.
Disclaimers
Nightbook is provided on an "as is" and "as available" basis, to the fullest extent permitted by applicable law. We make no warranties, express or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nightbook is a journaling tool and is not a substitute for professional medical, mental health, or therapeutic advice.
Limitation of liability
To the fullest extent permitted by applicable law, Nightbook and its officers, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of data, profits, or goodwill, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
Governing law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the effective date at the top of this page. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
